New York (NY) Will Book 267:252

I, Jefferson Applegate of the City of New York, being by the blessing of Almighty God of sound mind do make publish and declare this my last Will and Testament.

First – I direct that the expense of my funeral and all my just debts and liabilities which I may owe at the time of my death be fully paid and discharged.

Second – I give devise and bequeath to my Mother Margaret Woodward, wife of John Woodward all my claim right title interest and demand which I have or at any time may have in or upon the Fund arising or growing out of the estate of my father Elijah Applegate which is now held in trust to pay the income to my mother for her life.  It being my will and intention that upon my death my mother should receive the portion or share of the principal of said fund to which I might or would be entitled should I survive her.

Third – I give devise and bequeath to my said Mother Margaret Woodward all the rest residue and remainder of my estate real, personal, or mixed and wheresoever the same may be situated which I may own or to which I may be entitled at the time of my death.

Fourth – I nominate and appoint my mother Margaret Woodward Sole Elecutrix [sic] of this my last Will and Testament.

Fifth – I hereby revoke all other and former wills by me made and expressly declare this Instrument and none other to be my last Will and Testament.

In Witness Whereof I have hereunto set my hand and seal this nineteenth day of November Eighteen hundred and sixty seven.
